  (d)Thecontractingpartiesrecognizethat,asaresultofdomesticpoliciesdirectedtowardstheachievementandmaintenanceoffullandproductiveemploymentortowardsthedevelopmentofeconomicresources,acontractingpartymayexperienceahighlevelofdemandforimportsinvolvingathreattoitsmonetaryreservesofthesortreferredtoinparagraph2(a)ofthisArticle.Accordingly,acontractingpartyotherwisecomplyingwiththeprovisionsofthisArticleshallnotberequiredtowithdrawormodifyrestrictionsonthegroundthatachangeinthosepolicieswouldrenderunnecessaryrestrictionswhichitisapplyingunderthisArticle.

  21.Atanytimewhileameasureisbeingappliedunderparagraph17ofthisArticleanycontractingpartysubstantiallyaffectedbyitmaysuspendtheapplicationtothetradeofthecontractingpartyhavingrecoursetothisSectionofsuchsubstantiallyequivalentconcessionsorotherobligationsunderthisAgreementthesuspensionofwhichtheCONTRACTINGPARTIESdonotdisapprove;Providedthatsixtydays’noticeofsuchsuspensionisgiventotheCONTRACTINGPARTIESnotlaterthansixmonthsafterthemeasurehasbeenintroducedorchangedsubstantiallytothedetrimentofthecontractingpartyaffected.AnysuchcontractingpartyshallaffordadequateopportunityforconsultationinaccordancewiththeprovisionsofArticleXXIIofthisAgreement.

  3.TheprovisionsofArticleXIIIshallnotprecludeagroupofterritorieshavingacommonquotaintheInternationalMonetaryFundfromapplyingagainstimportsfromothercountries,butnotamongthemselves,restrictionsinaccordancewiththeprovisionsofArticleXIIorofSectionBofArticleXVIIIonconditionthatsuchrestrictionsareinallotherrespectsconsistentwiththeprovisionsofArticleXIII.

  23.按本节而施行的任何步伐,应契合本条第二十款的规则。

  Dueregardshallbepaidineithercasetoanyspecialfactorswhichmaybeaffectingthereservesofsuchcontractingpartyoritsneedforreserves,including,wherespecialexternalcreditsorotherresourcesareavailabletoit,theneedtoprovidefortheappropriateuseofsuchcreditsorresources.

  (ii)If,however,asaresultoftheconsultations,theCONTRACTINGPARTIESdeterminethattherestrictionsarebeingappliedinamannerinvolvinganinconsistencyofaseriousnaturewiththeprovisionsofthisSectionorwiththoseofArticleXIII(subjecttotheprovisionsofArticleXIV)andthatdamagetothetradeofanycontractingpartyiscausedorthreatenedthereby,theyshallsoinformthecontractingpartyapplyingtherestrictionsandshallmakeappropriaterecommendationsforsecuringconformitywithsuchprovisionswithinaspecifiedperiod.Ifsuchcontractingpartydoesnotcomplywiththeserecommendationswithinthespecifiedperiod,theCONTRACTINGPARTIESmayreleaseanycontractingpartythetradeofwhichisadverselyaffectedbytherestrictionsfromsuchobligationsunderthisAgreementtowardsthecontractingpartyapplyingtherestrictionsastheydeterminetobeappropriateinthecircumstances.

  (b)necessarytoprotecthuman,animalorplantlifeorhealth;

  2.InallcasesinwhichtheCONTRACTINGPARTIESarecalledupontoconsiderordealwithproblemsconcerningmonetaryreserves,balancesofpaymentsorforeignexchangearrangements,theyshallconsultfullywiththeInternationalMonetaryFund.Insuchconsultations,theCONTRACTINGPARTIESshallacceptallfindingsofstatisticalandotherfactspresentedbytheFundrelatingtoforeignexchange,monetaryreservesandbalancesofpayments,andshallacceptthedeterminationoftheFundastowhetheractionbyacontractingpartyinexchangemattersisinaccordancewiththeArticlesofAgreementoftheInternationalMonetaryFund,orwiththetermsofaspecialexchangeagreementbetweenthatcontractingpartyandtheCONTRACTINGPARTIES.TheCONTRACTINGPARTIESinreachingtheirfinaldecisionincasesinvolvingthecriteriasetforthinparagraph2(a)ofArticleXIIorinparagraph9ofArticleXVIII,shallacceptthedeterminationoftheFundastowhatconstitutesaseriousdeclineinthecontractingparty’smonetaryreserves,averylowlevelofitsmonetaryreservesorareasonablerateofincreaseinitsmonetaryreserves,andastothefinancialaspectsofothermatterscoveredinconsultationinsuchcases.

  (iii)torestrictthequantitiespermittedtobeproducedofanyanimalproducttheproductionofwhichisdirectlydependent,whollyormainly,ontheimportedcommodity,ifthedomesticproductionofthatcommodityisrelativelynegligible.

  5.假如须耐久而普遍地维持按本条施行的出口限定,标明存在着广泛的不屈衡限定着国际商业的开展,则缔约国全体应召闭会议来讨论能否可由国际出入蒙受压力的缔约国,或由国际出入趋势十分有利的缔约国,或由得当的国际机构,接纳其他方法以肃清形成不屈衡的内涵要素。如缔约国全体收回这种约请,缔约列国应参与这种讨论。

  (f)Inproceedingunderthisparagraph,theCONTRACTINGPARTIESshallhavedueregardtothefactorsreferredtoinparagraph2ofthisArticle.Determinationsunderthisparagraphshallberenderedexpeditiouslyand,ifpossible,withinsixtydaysoftheinitiationoftheconsultations.

  8.不是国际钱币基金成员的缔约国应向缔约国全体提供其为实行本协议规则的义务而需求的国际钱币基金协议第八条第五节范畴内的普通材料。

  (d)TheCONTRACTINGPARTIESshallinviteanycontractingpartywhichisapplyingrestrictionsunderthisSectiontoenterintoconsultationswiththemattherequestofanycontractingpartywhichcanestablishaprimafaciecasethattherestrictionsareinconsistentwiththeprovisionsofthisSectionorwiththoseofArticleXIII(subjecttotheprovisionsofArticleXIV)andthatitstradeisadverselyaffectedthereby.However,nosuchinvitationshallbeissuedunlesstheCONTRACTINGPARTIEShaveascertainedthatdirectdiscussionsbetweenthecontractingpartiesconcernedhavenotbeensuccessful.If,asaresultoftheconsultationswiththeCONTRACTINGPARTIESnoagreementisreachedandtheydeterminethattherestrictionsarebeingappliedinconsistentlywithsuchprovisions,andthatdamagetothetradeofthecontractingpartyinitiatingtheprocedureiscausedorthreatenedthereby,theyshallrecommendthewithdrawalormodificationoftherestrictions.IftherestrictionsarenotwithdrawnormodifiedwithinsuchtimeastheCONTRACTINGPARTIESmayprescribe,theymayreleasethecontractingpartyinitiatingtheprocedurefromsuchobligationsunderthisAgreementtowardsthecontractingpartyapplyingtherestrictionsastheydeterminetobeappropriateinthecircumstances.

  1.AcontractingpartywhichappliesrestrictionsunderArticleXIIorunderSectionBofArticleXVIIImay,intheapplicationofsuchrestrictions,deviatefromtheprovisionsofArticleXIIIinamannerhavingequivalenteffecttorestrictionsonpaymentsandtransfersforcurrentinternationaltransactionswhichthatcontractingpartymayatthattimeapplyunderArticleVIIIorXIVoftheArticlesofAgreementoftheInternationalMonetaryFund,orunderanalogousprovisionsofaspecialexchangeagreemententeredintopursuanttoparagraph6ofArticleXV.

  ArticleXVII:StateTradingEnterprises第十七条公营商业企业

  (丁)为包管某些与本协议的规则并无冲突的法则或条例的贯彻实行所必须的步伐,包罗增强海关法则或条例,增强依据本协议第二条第四款和第十四条而施行的把持,维护专利权、牌号及版权,以及避免诈骗举动所必须的步伐;

  4.(甲)因而,但凡只能维持低生存程度经济处在开展初期阶段的缔约国,有权按本条第一节、第二节和第三节临时背叛本协议其他各条的规则。

  Subjecttotherequirementthatsuchmeasuresarenotappliedinamannerwhichwouldconstituteameansofarbitraryorunjustifiablediscriminationbetweencountrieswherethesameconditionsprevail,oradisguisedrestrictiononinternationaltrade,nothinginthisAgreementshallbeconstruedtopreventtheadoptionorenforcementbyanycontractingpartyofmeasures:

  12.(甲)树立新的限定,或许大幅度增强按本节施行的步伐因此进步现行限定普通程度的任何缔约国,应于树立或增强限定后(如能事前协商则应于树立或增强前)立刻与缔约国全体就本人国际出入困难的性子,能够接纳的其他弥补方法,以及这些限定对其他缔约国的经济能够形成的影响,停止协商。

  12.(a)AnycontractingpartyapplyingnewrestrictionsorraisingthegenerallevelofitsexistingrestrictionsbyasubstantialintensificationofthemeasuresappliedunderthisSection,shallimmediatelyafterinstitutingorintensifyingsuchrestrictions(or,incircumstancesinwhichpriorconsultationispracticable,beforedoingso)consultwiththeCONTRACTINGPARTIESastothenatureofitsbalanceofpaymentsdifficulties,alternativecorrectivemeasureswhichmaybeavailable,andthepossibleeffectoftherestrictionsontheeconomiesofothercontractingparties.

  第十三条非鄙视地施行数目限定

  (c)relatingtotheimportationsorexportationsofgoldorsilver;

  (丙)当一缔约国有来由以为,它按本协议可享用的长处由于本款(甲)项所述企业的运动正在遭到侵害,它可以向缔约国全体提出恳求,缔约国全体可以据此要求树立、维持或受权树立这种企业的谁人缔约国,就其实行本协议的状况提供材料。

  SectionA—SubsidiesinGeneral第一节普通补助

  ThecontractingpartyhavingrecoursetothisSectionshallthereuponbereleasedfromitsobligationsundertherelevantprovisionsoftheotherArticlesofthisAgreementtotheextentnecessarytopermitittoapplythemeasure.

  (a)Whereverpracticable,quotasrepresentingthetotalamountofpermittedimports(whetherallocatedamongsupplyingcountriesornot)shallbefixed,andnoticegivenoftheiramountinaccordancewithparagraph3(b)ofthisArticle;

  6.TheCONTRACTINGPARTIESshallreviewannuallyallmeasuresappliedpursuanttotheprovisionsofSectionsCandDofthisArticle.

  第十八条当局对经济开展的救济

  7.(甲)一缔约国与缔约国全体依据本条第六款签署的外汇特殊协议,须有使缔约国全体称心的下述规则:这一缔约国在外汇题目上接纳的举动,将无妨碍本协议的主旨的完成。

  (a)thatagreementhasbeenreachedwithsuchothercontractingpartiesasaresultoftheconsultationsreferredtoabove,or

  2.Thecontractingpartiesrecognizefurtherthatitmaybenecessaryforthosecontractingparties,inordertoimplementprogrammesandpoliciesofeconomicdevelopmentdesignedtoraisethegeneralstandardoflivingoftheirpeople,totakeprotectiveorothermeasuresaffectingimports,andthatsuchmeasuresarejustifiedinsofarastheyfacilitatetheattainmentoftheobjectivesofthisAgreement.Theyagree,therefore,thatthosecontractingpartiesshouldenjoyadditionalfacilitiestoenablethem(a)tomaintainsufficientflexibilityintheirtariffstructuretobeabletograntthetariffprotectionrequiredfortheestablishmentofaparticularindustryand(b)toapplyquantitativerestrictionsforbalanceofpaymentspurposesinamannerwhichtakesfullaccountofthecontinuedhighlevelofdemandforimportslikelytobegeneratedbytheirprogrammesofeconomicdevelopment.

  (乙)为保证人民、动动物的生命或安康所必须的步伐;

  (b)theusebyacontractingpartyofrestrictionsorcontrolsinimportsorexports,thesoleeffectofwhich,additionaltotheeffectspermittedunderArticlesXI,XII,XIIIandXIV,istomakeeffectivesuchexchangecontrolsorexchangerestrictions.

  9.NothinginthisAgreementshallpreclude:9.本协议无妨碍:

  1.TheCONTRACTINGPARTIESshallseekco-operationwiththeInternationalMonetaryFundtotheendthattheCONTRACTINGPARTIESandtheFundmaypursueaco-ordinatedpolicywithregardtoexchangequestionswithinthejurisdictionoftheFundandquestionsofquantitativerestrictionsandothertrademeasureswithinthejurisdictionoftheCONTRACTINGPARTIES.

  2.Beforeanycontractingpartyshalltakeactionpursuanttotheprovisionsofparagraph1ofthisArticle,itshallgivenoticeinwritingtotheCONTRACTINGPARTIESasfarinadvanceasmaybepracticableandshallaffordtheCONTRACTINGPARTIESandthosecontractingpartieshavingasubstantialinterestasexportersoftheproductconcernedanopportunitytoconsultwithitinrespectoftheproposedaction.Whensuchnoticeisgiveninrelationtoaconcessionwithrespecttoapreference,thenoticeshallnamethecontractingpartywhichhasrequestedtheaction.Incriticalcircumstances,wheredelaywouldcausedamagewhichitwouldbedifficulttorepair,actionunderparagraph1ofthisArticlemaybetakenprovisionallywithoutpriorconsultation,ontheconditionthatconsultationshallbeeffectedimmediatelyaftertakingsuchaction.

  20.本节前述各款并非受权可以对本协议第一条、第二条和第八条的规则有任何偏离。本条第十款的但书也实用于依据本节而接纳的任何限定。

  (2)对钱币储藏很低的缔约国,为了使储藏公道增长所必须的水平。

  (b)Eachcontractingpartyshallmaintain,orinstituteassoonaspracticable,judicial,arbitraloradministrativetribunalsorproceduresforthepurpose,interalia,ofthepromptreviewandcorrectionofadministrativeactionrelatingtocustomsmatters.Suchtribunalsorproceduresshallbeindependentoftheagenciesentrustedwithadministrativeenforcementandtheirdecisionsshallbeimplementedby,andshallgovernthepracticeof,suchagenciesunlessanappealislodgedwithacourtortribunalofsuperiorjurisdictionwithinthetimeprescribedforappealstobelodgedbyimporters;Providedthatthecentraladministrationofsuchagencymaytakestepstoobtainareviewofthematterinanotherproceedingifthereisgoodcausetobelievethatthedecisionisinconsistentwithestablishedprinciplesoflawortheactualfacts.

  (甲)为了防备钱币储藏严峻降落的要挟或克制钱币储藏降落所必须的水平,或许

  16.IfitisrequestedbytheCONTRACTINGPARTIEStodoso,thecontractingpartyconcernedshallconsultwiththemastothepurposeoftheproposedmeasure,astoalternativemeasureswhichmaybeavailableunderthisAgreement,andastothepossibleeffectofthemeasureproposedonthecommercialandeconomicinterestsofothercontractingparties.If,asaresultofsuchconsultation,theCONTRACTINGPARTIESagreethatthereisnomeasureconsistentwiththeotherprovisionsofthisAgreementwhichispracticableinordertoachievetheobjectiveoutlinedinparagraph13ofthisArticle,andconcurintheproposedmeasure,thecontractingpartyconcernedshallbereleasedfromitsobligationsundertherelevantprovisionsoftheotherArticlesofthisAgreementtotheextentnecessarytoapplythatmeasure.

  4.缔约列国不得以外汇方面的举动,来阻碍本协议各项规则的意图的完成,也不得以商业方面的举动,阻碍国际钱币基金协议各项规则的意图的完成。

  (1)为了防备钱币储藏严峻降落的急迫要挟或克制钱币储藏严峻降落所必需的水平;或

  (b)OnadatetobedeterminedbythemtheCONTRACTINGPARTIESshallreviewallrestrictionsstillappliedunderthisSectiononthatdate.Beginningtwoyearsafterthatdate,contractingpartiesapplyingrestrictionsunderthisSectionshallenterintoconsultationsofthetypeprovidedforinsubparagraph(a)abovewiththeCONTRACTINGPARTIESatintervalsofapproximately,butnotlessthan,twoyearsaccordingtoaprogrammetobedrawnupeachyearbytheCONTRACTINGPARTIES;Providedthatnoconsultationunderthissubparagraphshalltakeplacewithintwoyearsaftertheconclusionofaconsultationofageneralnatureunderanyotherprovisionofthisparagraph.

  4.Contractingpartiesshallnot,byexchangeaction,frustratetheintentoftheprovisionsofthisAgreement,nor,bytradeaction,theintentoftheprovisionsoftheArticlesofAgreementoftheInternationalMonetaryFund.

  3.(甲)缔约列国应以一致、公平和公道的方法施行本条第一款所述的法则、条例、讯断和决议。

  (b)Ifanyproduct,whichisthesubjectofaconcessionwithrespecttoapreference,isbeingimportedintotheterritoryofacontractingpartyinthecircumstancessetforthinsubparagraph(a)ofthisparagraph,soastocauseorthreatenseriousinjurytodomesticproducersoflikeordirectlycompetitiveproductsintheterritoryofacontractingpartywhichreceivesorreceivedsuchpreference,theimportingcontractingpartyshallbefree,ifthatothercontractingpartysorequests,tosuspendtherelevantobligationinwholeorinpartortowithdrawormodifytheconcessioninrespectoftheproduct,totheextentandforsuchtimeasmaybenecessarytopreventorremedysuchinjury.

  2.(a)Importrestrictionsinstituted,maintainedorintensifiedbyacontractingpartyunderthisArticleshallnotexceedthosenecessary:

  5.TheCONTRACTINGPARTIESshallreviewtheoperationoftheprovisionsofthisArticlefromtimetotimewithaviewtoexaminingitseffectiveness,inthelightofactualexperience,inpromotingtheobjectivesofthisAgreementandavoidingsubsidizationseriouslyprejudicialtothetradeorinterestsofcontractingparties.

  (b)underthepreferentialarrangementsprovidedforinAnnexAofthisAgreement,pendingtheoutcomeofthenegotiationsreferredtotherein.

  22.Acontractingpartycomingwithinthescopeofsubparagraph4(b)ofthisArticledesiring,intheinterestofthedevelopmentofitseconomy,tointroduceameasureofthetypedescribedinparagraph13ofthisArticleinrespectoftheestablishmentofaparticularindustrymayapplytotheCONTRACTINGPARTIESforapprovalofsuchmeasure.TheCONTRACTINGPARTIESshallpromptlyconsultwithsuchcontractingpartyandshall,inmakingtheirdecision,beguidedbytheconsiderationssetoutinparagraph16.IftheCONTRACTINGPARTIESconcurintheproposedmeasurethecontractingpartyconcernedshallbereleasedfromitsobligationsundertherelevantprovisionsoftheotherArticlesofthisAgreementtotheextentnecessarytopermitittoapplythemeasure.IftheproposedmeasureaffectsaproductwhichisthesubjectofaconcessionincludedintheappropriateScheduleannexedtothisAgreement,theprovisionsofparagraph18shallapply.

  4.本协议第十一条至第十五条或本协议第十八条第二节的规则,并不制止依照本协议第十二条或依照本协议第十八条第二节施行限定的一缔约国接纳不违背本协议第十三条规则的步伐以指点出口,添加外汇支出。

  (b)ifnosuchagreementhasbeenreachedwithinsixtydaysafterthenotificationprovidedforinparagraph14hasbeenreceivedbytheCONTRACTINGPARTIES,thatthecontractingpartyhavingrecoursetothisSectionhasmadeallreasonableeffortstoreachanagreementandthattheinterestsofothercontractingpartiesareadequatelysafeguarded.

  4.(甲)缔约列国应将本条第一款(甲)项所述企业输出到它们的国土或从它们的国土输入的产物告诉缔约国全体。

  SectionA第一节

  7.(a)Ifacontractingpartycomingwithinthescopeofparagraph4(a)ofthisArticleconsidersitdesirable,inordertopromotetheestablishmentofaparticularindustrywithaviewtoraisingthegeneralstandardoflivingofitspeople,tomodifyorwithdrawaconcessionincludedintheappropriateScheduleannexedtothisAgreement,itshallnotifytheCONTRACTINGPARTIEStothiseffectandenterintonegotiationswithanycontractingpartywithwhichsuchconcessionwasinitiallynegotiated,andwithanyothercontractingpartydeterminedbytheCONTRACTINGPARTIEStohaveasubstantialinteresttherein.Ifagreementisreachedbetweensuchcontractingpartiesconcerned,theyshallbefreetomodifyorwithdrawconcessionsundertheappropriateSchedulestothisAgreementinordertogiveeffecttosuchagreement,includinganycompensatoryadjustmentsinvolved.

  2.Theprovisionsofparagraph1ofthisArticleshallnotapplytoimportsofproductsforimmediateorultimateconsumptioningovernmentaluseandnototherwiseforresaleoruseintheproductionofgoodsforsale.Withrespecttosuchimports,eachcontractingpartyshallaccordtothetradeoftheothercontractingpartiesfairandequitabletreatment.

  17.按本条第十四款提出的步伐告诉缔约国全体当前,缔约国全体若在90天内尚未表现赞同,有关缔约国于陈诉缔约国全体后可以接纳这一步伐。

  1.Laws,regulations,judicialdecisionsandadministrativerulingsofgeneralapplication,madeeffectivebyanycontractingparty,pertainingtotheclassificationorthevaluationofproductsforcustomspurposes,ortoratesofduty,taxesorothercharges,ortorequirements,restrictionsorprohibitionsonimportsorexportsoronthetransferofpaymentstherefor,oraffectingtheirsale,distribution,transportation,insurance,warehousinginspection,exhibition,processing,mixingorotheruse,shallbepublishedpromptlyinsuchamannerastoenablegovernmentsandtraderstobecomeacquaintedwiththem.Agreementsaffectinginternationaltradepolicywhichareinforcebetweenthegovernmentoragovernmentalagencyofanycontractingpartyandthegovernmentorgovernmentalagencyofanyothercontractingpartyshallalsobepublished.Theprovisionsofthisparagraphshallnotrequireanycontractingpartytodiscloseconfidentialinformationwhichwouldimpedelawenforcementorotherwisebecontrarytothepublicinterestorwouldprejudicethelegitimatecommercialinterestsofparticularenterprises,publicorprivate.

  3.Thecontractingpartiesrecognizefinallythat,withthoseadditionalfacilitieswhichareprovidedforinSectionsAandBofthisArticle,theprovisionsofthisAgreementwouldnormallybesufficienttoenablecontractingpartiestomeettherequirementsoftheireconomicdevelopment.Theyagree,however,thattheremaybecircumstanceswherenomeasureconsistentwiththoseprovisionsispracticabletopermitacontractingpartyintheprocessofeconomicdevelopmenttograntthegovernmentalassistancerequiredtopromotetheestablishmentofparticularindustrieswithaviewtoraisingthegeneralstandardoflivingofitspeople.SpecialproceduresarelaiddowninSectionsCandDofthisArticletodealwiththosecases.

  Anycontractingpartyapplyingrestrictionsontheimportationofanyproductpursuanttosubparagraph(c)ofthisparagraphshallgivepublicnoticeofthetotalquantityorvalueoftheproductpermittedtobeimportedduringaspecifiedfutureperiodandofanychangeinsuchquantityorvalue.Moreover,anyrestrictionsappliedunder(i)aboveshallnotbesuchaswillreducethetotalofimportsrelativetothetotalofdomesticproduction,ascomparedwiththeproportionwhichmightreasonablybeexpectedtorulebetweenthetwointheabsenceofrestrictions.Indeterminingthisproportion,thecontractingpartyshallpaydueregardtotheproportionprevailingduringapreviousrepresentativeperiodandtoanyspecialfactorswhichmayhaveaffectedormaybeaffectingthetradeintheproductconcerned.

  (乙)在未经事前协商即按本条第二款接纳举动因而对一缔约国国土产物的国际消费者形成严峻侵害或发生严峻要挟的状况下,虽然有本款(甲)项的规则,假如耽误会形成难于弥补的丧失,则那一缔约国在这项举动接纳当前以及在整个协商时期,可以停息施行避免或改正侵害所必须的那种减让或其他任务。

  18.IftheproposedmeasureaffectsaproductwhichisthesubjectofaconcessionincludedintheappropriateScheduleannexedtothisAgreement,thecontractingpartyconcernedshallenterintoconsultationswithanyothercontractingpartywithwhichtheconcessionwasinitiallynegotiated,andwithanyothercontractingpartydeterminedbytheCONTRACTINGPARTIEStohaveasubstantialinteresttherein.TheCONTRACTINGPARTIESshallconcurinthemeasureiftheyagreethatthereisnomeasureconsistentwiththeotherprovisionsofthisAgreementwhichispracticableinordertoachievetheobjectivesetforthinparagraph13ofthisArticle,andiftheyaresatisfied:

  (2)但是,如缔约国全体经协商后以为正在施行的限定严峻地与本节或与本协议第十三条(受本协议第十四条的限定)的规则不符,以为它对另一缔约国的商业形成侵害或组成要挟,它们应将这一状况告诉施行限定的缔约国,并应提出得当的发起以包管这些规则在肯定限期内能失掉恪守。照实施限定的缔约国在规则限期内不实行这些发起,缔约国全体在以为须要时,可以排除商业遭到倒霉影响的谁人缔约国依据本协议对施行限定的缔约国所承当的任务。

  (c)Theprovisionsofsubparagraph(b)ofthisparagraphshallnotrequiretheeliminationorsubstitutionofproceduresinforceintheterritoryofacontractingpartyonthedateofthisAgreementwhichinfactprovideforanobjectiveandimpartialreviewofadministrativeactioneventhoughsuchproceduresarenotfullyorformallyindependentoftheagenciesentrustedwithadministrativeenforcement.Anycontractingpartyemployingsuchproceduresshall,uponrequest,furnishtheCONTRACTINGPARTIESwithfullinformationthereoninorderthattheymaydeterminewhethersuchproceduresconformtotherequirementsofthissubparagraph.

  ArticleXI:GeneralEliminationofQuantitativeRestrictions第十一条数目限定的普通取消

  ArticleXVIII:GovernmentalAssistancetoEconomicDevelopment

  (b)ThetermsofanysuchagreementshallnotimposeobligationsonthecontractingpartyinexchangemattersgenerallymorerestrictivethanthoseimposedbytheArticlesofAgreementoftheInternationalMonetaryFundonmembersoftheFund.

  1.(a)If,asaresultofunforeseendevelopmentsandoftheeffectoftheobligationsincurredbyacontractingpartyunderthisAgreement,includingtariffconcessions,anyproductisbeingimportedintotheterritoryofthatcontractingpartyinsuchincreasedquantitiesandundersuchconditionsastocauseorthreatenseriousinjurytodomesticproducersinthatterritoryoflikeordirectlycompetitiveproducts,thecontractingpartyshallbefree,inrespectofsuchproduct,andtotheextentandforsuchtimeasmaybenecessarytopreventorremedysuchinjury,tosuspendtheobligationinwholeorinpartortowithdrawormodifytheconcession.

  (b)Incasesinwhichquotasarenotpracticable,therestrictionsmaybeappliedbymeansofimportlicencesorpermitswithoutaquota;

  缔约国依照本款(丙)项对某项产物施行出口限定时,应发布以后指定时期内准予出口的产物的全部数目或代价以及能够的变化。同时,依据上述(1)项而施行的限定,不该使产物的出口总量与其国际消费总量间的比例,低于若不实行限定可以公道预期到达的比例。缔约国在确定这个比例时,对前一有代表性的时期的比例以及能够已经影响或正在影响这个产物商业的任何特别要素,均应赐与得当的思索。

  19.Ifaproposedmeasureofthetypedescribedinparagraph13ofthisArticleconcernsanindustrytheestablishmentofwhichhasintheinitialperiodbeenfacilitatedbyincidentalprotectionaffordedbyrestrictionsimposedbythecontractingpartyconcernedforbalanceofpaymentspurposesundertherelevantprovisionsofthisAgreement,thatcontractingpartymayresorttotheprovisionsandproceduresofthisSection;ProvidedthatitshallnotapplytheproposedmeasurewithouttheconcurrenceoftheCONTRACTINGPARTIES.

  (c)(i)If,inthecourseofconsultationswithacontractingpartyundersubparagraph(a)or(b)ofthisparagraph,theCONTRACTINGPARTIESfindthattherestrictionsarenotconsistentwiththeprovisionsofthisSectionorwiththoseofArticleXIII(subjecttotheprovisionsofArticleXIV),theyshallindicatethenatureoftheinconsistencyandmayadvisethattherestrictionsbesuitablymodified.

  (e)Ifacontractingpartyagainstwhichactionhasbeentakeninaccordancewiththelastsentenceofsubparagraph(c)(ii)or(d)ofthisparagraph,findsthatthereleaseofobligationsauthorizedbytheCONTRACTINGPARTIESadverselyaffectstheoperationofitsprogrammeandpolicyofeconomicdevelopment,itshallbefree,notlaterthansixtydaysaftersuchactionistaken,togivewrittennoticetotheExecutiveSecretary(2)totheContractingPartiesofitsintentiontowithdrawfromthisAgreementandsuchwithdrawalshalltakeeffectonthesixtiethdayfollowingthedayonwhichthenoticeisreceivedbyhim.

  14.ThecontractingpartyconcernedshallnotifytheCONTRACTINGPARTIESofthespecialdifficultieswhichitmeetsintheachievementoftheobjectiveoutlinedinparagraph13ofthisArticleandshallindicatethespecificmeasureaffectingimportswhichitproposestointroduceinordertoremedythesedifficulties.Itshallnotintroducethatmeasurebeforetheexpirationofthetime-limitlaiddowninparagraph15or17,asthecasemaybe,orifthemeasureaffectsimportsofaproductwhichisthesubjectofaconcessionincludedintheappropriateScheduleannexedtothisAgreement,unlessithassecuredtheconcurrenceoftheCONTRACTINGPARTIESinaccordancewithprovisionsofparagraph18;Providedthat,iftheindustryreceivingassistancehasalreadystartedproduction,thecontractingpartymay,afterinformingtheCONTRACTINGPARTIES,takesuchmeasuresasmaybenecessarytoprevent,duringthatperiod,importsoftheproductorproductsconcernedfromincreasingsubstantiallyaboveanormallevel.

  17.If,withinninetydaysafterthedateofthenotificationoftheproposedmeasureunderparagraph14ofthisArticle,theCONTRACTINGPARTIEShavenotconcurredinsuchmeasure,thecontractingpartyconcernedmayintroducethemeasureproposedafterinformingtheCONTRACTINGPARTIES.

  8.AcontractingpartywhichisnotamemberoftheFundshallfurnishsuchinformationwithinthegeneralscopeofsection5ofArticleVIIIoftheArticlesofAgreementoftheInternationalMonetaryFundastheCONTRACTINGPARTIESmayrequireinordertocarryouttheirfunctionsunderthisAgreement.

  ArticleXV:ExchangeArrangements第十五条外汇布置

  1.(a)EachcontractingpartyundertakesthatifitestablishesormaintainsaStateenterprise,whereverlocated,orgrantstoanyenterprise,formallyorineffect,exclusiveorspecialprivileges,suchenterpriseshall,initspurchasesorsalesinvolvingeitherimportsorexports,actinamannerconsistentwiththegeneralprinciplesofnon-discriminatorytreatmentprescribedinthisAgreementforgovernmentalmeasuresaffectingimportsorexportsbyprivatetraders.

  (j)essentialtotheacquisitionordistributionofproductsingeneralorlocalshortsupply;Providedthatanysuchmeasuresshallbeconsistentwiththeprinciplethatallcontractingpartiesareentitledtoanequitableshareoftheinternationalsupplyofsuchproducts,andthatanysuchmeasures,whichareinconsistentwiththeotherprovisionsoftheAgreementshallbediscontinuedassoonastheconditionsgivingrisetothemhaveceasedtoexist.TheCONTRACTINGPARTIESshallreviewtheneedforthissub-paragraphnotlaterthan30June1960.

  ArticleXII:RestrictionstoSafeguardtheBalanceofPayments

  11.Incarryingoutitsdomesticpolicies,thecontractingpartyconcernedshallpaydueregardtotheneedforrestoringequilibriuminitsbalanceofpaymentsonasoundandlastingbasisandtothedesirabilityofassuringaneconomicemploymentofproductiveresources.ItshallprogressivelyrelaxanyrestrictionsappliedunderthisSectionasconditionsimprove,maintainingthemonlytotheextentnecessaryunderthetermsofparagraph9ofthisArticleandshalleliminatethemwhenconditionsnolongerjustifysuchmaintenance;ProvidedthatnocontractingpartyshallberequiredtowithdrawormodifyrestrictionsonthegroundthatachangeinitsdevelopmentpolicywouldrenderunnecessarytherestrictionswhichitisapplyingunderthisSection.

  7.(a)AspecialexchangeagreementbetweenacontractingpartyandtheCONTRACTINGPARTIESunderparagraph6ofthisArticleshallprovidetothesatisfactionoftheCONTRACTINGPARTIESthattheobjectivesofthisAgreementwillnotbefrustratedasaresultofactioninexchangemattersbythecontractingpartyinquestion.

  (d)Theprovisionsofthisparagraphshallnotrequireanycontractingpartytodiscloseconfidentialinformationwhichwouldimpedelawenforcementorotherwisebecontrarytothepublicinterestorwouldprejudicethelegitimatecommercialinterestsofparticularenterprises.

  (b)Inthecaseofimportrestrictionsinvolvingthefixingofquotas,thecontractingpartyapplyingtherestrictionsshallgivepublicnoticeofthetotalquantityorvalueoftheproductorproductswhichwillbepermittedtobeimportedduringaspecifiedfutureperiodandofanychangeinsuchquantityorvalue.Anysuppliesoftheproductinquestionwhichwereenrouteatthetimeatwhichpublicnoticewasgivenshallnotbeexcludedfromentry;Providedthattheymaybecountedsofaraspracticable,againstthequantitypermittedtobeimportedintheperiodinquestion,andalso,wherenecessary,againstthequantitiespermittedtobeimportedinthenextfollowingperiodorperiods;andProvidedfurtherthatifanycontractingpartycustomarilyexemptsfromsuchrestrictionsproductsenteredforconsumptionorwithdrawnfromwarehouseforconsumptionduringaperiodofthirtydaysafterthedayofsuchpublicnotice,suchpracticeshallbeconsideredfullcompliancewiththissubparagraph.

  3.(a)Eachcontractingpartyshalladministerinauniform,impartialandreasonablemannerallitslaws,regulations,decisionsandrulingsofthekinddescribedinparagraph1ofthisArticle.

  2.Thecontractingpartiesrecognizethatthegrantingbyacontractingpartyofasubsidyontheexportofanyproductmayhaveharmfuleffectsforothercontractingparties,bothimportingandexporting,maycauseunduedisturbancetotheirnormalcommercialinterests,andmayhindertheachievementoftheobjectivesofthisAgreement.

  3.(a)Ifagreementamongtheinterestedcontractingpartieswithrespecttotheactionisnotreached,thecontractingpartywhichproposestotakeorcontinuetheactionshall,nevertheless,befreetodoso,andifsuchactionistakenorcontinued,theaffectedcontractingpartiesshallthenbefree,notlaterthanninetydaysaftersuchactionistaken,tosuspend,upontheexpirationofthirtydaysfromthedayonwhichwrittennoticeofsuchsuspensionisreceivedbytheCONTRACTINGPARTIES,theapplicationtothetradeofthecontractingpartytakingsuchaction,or,inthecaseenvisagedinparagraph1(b)ofthisArticle,tothetradeofthecontractingpartyrequestingsuchaction,ofsuchsubstantiallyequivalentconcessionsorotherobligationsunderthisAgreementthesuspensionofwhichtheCONTRACTINGPARTIESdonotdisapprove.

  5.Thecontractingpartiesrecognizethattheexportearningsofcontractingparties,theeconomiesofwhichareofthetypedescribedinparagraph4(a)and(b)aboveandwhichdependonexportsofasmallnumberofprimarycommodities,maybeseriouslyreducedbyadeclineinthesaleofsuchcommodities.Accordingly,whentheexportsofprimarycommoditiesbysuchacontractingpartyareseriouslyaffectedbymeasurestakenbyanothercontractingparty,itmayhaveresorttotheconsultationprovisionsofArticleXXIIofthisAgreement.

  4.Further,asfrom1January1958ortheearliestpracticabledatethereafter,contractingpartiesshallceasetogranteitherdirectlyorindirectlyanyformofsubsidyontheexportofanyproductotherthanaprimaryproductwhichsubsidyresultsinthesaleofsuchproductforexportatapricelowerthanthecomparablepricechargedforthelikeproducttobuyersinthedomesticmarket.Until31December1957nocontractingpartyshallextendthescopeofanysuchsubsidizationbeyondthatexistingon1January1955bytheintroductionofnew,ortheextensionofexisting,subsidies.

  (a)necessarytoprotectpublicmorals;

  SectionB—AdditionalProvisionsonExportSubsidies第二节对出口补助的附加规则

  5.IfthereisapersistentandwidespreadapplicationofimportrestrictionsunderthisArticle,indicatingtheexistenceofageneraldisequilibriumwhichisrestrictinginternationaltrade,theCONTRACTINGPARTIESshallinitiatediscussionstoconsiderwhetherothermeasuresmightbetaken,eitherbythosecontractingpartiesthebalanceofpaymentsofwhichareunderpressureorbythosethebalanceofpaymentsofwhicharetendingtobeexceptionallyfavourable,orbyanyappropriateintergovernmentalorganization,toremovetheunderlyingcausesofthedisequilibrium.OntheinvitationoftheCONTRACTINGPARTIES,contractingpartiesshallparticipateinsuchdiscussions.

  (e)relatingtotheproductsofprisonlabour;

  (a)theusebyacontractingpartyofexchangecontrolsorexchangerestrictionsinaccordancewiththeArticlesofAgreementoftheInternationalMonetaryFundorwiththatcontractingparty’sspecialexchangeagreementwiththeCONTRACTINGPARTIES,or

  2.(甲)一缔约国依据本条规则而树立、维持或增强的出口限定,不得超越:

  第十二条为保证国际出入而施行的限定

  (乙)但凡经济处在开展阶段,但又不属于上述(甲)项规则范畴的缔约国,可以依据本条第四节的规则向缔约国全体提出请求。

  (乙)属于优惠减让工具的某一产物,如在本款(甲)项所述情况下输出到一缔约国国土,并因而对现在或过来享用这种优惠的另一缔约国国土内的相反产物或与它间接竞争的产物的国际消费者形成严峻侵害或发生严峻要挟时,经这一另缔约国提出恳求后,输出这种产物的缔约国可以在避免或改正这种侵害所必须的水平和工夫内,全部或局部地对这种产物停息施行所承当的有关减让,或许打消或修正减让。

  (i)toavoidunnecessarydamagetothecommercialoreconomicinterestsofanyothercontractingparty;

  3.(a)Incasesinwhichimportlicencesareissuedinconnectionwithimportrestrictions,thecontractingpartyapplyingtherestrictionsshallprovide,upontherequestofanycontractingpartyhavinganinterestinthetradeintheproductconcerned,allrelevantinformationconcerningtheadministrationoftherestrictions,theimportlicencesgrantedoverarecentperiodandthedistributionofsuchlicencesamongsupplyingcountries;Providedthatthereshallbenoobligationtosupplyinformationastothenamesofimportingorsupplyingenterprises.

  4.Withregardtorestrictionsappliedinaccordancewithparagraph2(d)ofthisArticleorunderparagraph2(c)ofArticleXI,theselectionofarepresentativeperiodforanyproductandtheappraisalofanyspecialfactorsaffectingthetradeintheproductshallbemadeinitiallybythecontractingpartyapplyingtherestriction;Providedthatsuchcontractingpartyshall,upontherequestofanyothercontractingpartyhavingasubstantialinterestinsupplyingthatproductorupontherequestoftheCONTRACTINGPARTIES,consultpromptlywiththeothercontractingpartyortheCONTRACTINGPARTIESregardingtheneedforanadjustmentoftheproportiondeterminedorofthebaseperiodselected,orforthereappraisalofthespecialfactorsinvolved,orfortheeliminationofconditions,formalitiesoranyotherprovisionsestablishedunilaterallyrelatingtotheallocationofanadequatequotaoritsunrestrictedutilization.

  (b)Acontractingparty,theeconomyofwhichisintheprocessofdevelopment,butwhichdoesnotcomewithinthescopeofsubparagraph(a)above,maysubmitapplicationstotheCONTRACTINGPARTIESunderSectionDofthisArticle.

  (d)TheCONTRACTINGPARTIESshallinviteanycontractingpartywhichisapplyingrestrictionsunderthisArticletoenterintoconsultationswiththemattherequestofanycontractingpartywhichcanestablishaprimafaciecasethattherestrictionsareinconsistentwiththeprovisionsofthisArticleorwiththoseofArticleXIII(subjecttotheprovisionsofArticleXIV)andthatitstradeisadverselyaffectedthereby.However,nosuchinvitationshallbeissuedunlesstheCONTRACTINGPARTIEShaveascertainedthatdirectdiscussionsbetweenthecontractingpartiesconcernedhavenotbeensuccessful.If,asaresultoftheconsultationswiththeCONTRACTINGPARTIES,noagreementisreachedandtheydeterminethattherestrictionsarebeingappliedinconsistentlywithsuchprovisions,andthatdamagetothetradeofthecontractingpartyinitiatingtheprocedureiscausedorthreatenedthereby,theyshallrecommendthewithdrawalormodificationoftherestrictions.IftherestrictionsarenotwithdrawnormodifiedwithinsuchtimeastheCONTRACTINGPARTIESmayprescribe,theymayreleasethecontractingpartyinitiatingtheprocedurefromsuchobligationsunderthisAgreementtowardsthecontractingpartyapplyingtherestrictionsastheydeterminetobeappropriateinthecircumstances.

  ArticleXIV:ExceptionstotheRuleofNon-discrimination第十四条非鄙视准绳的破例

  2.Inapplyingimportrestrictionstoanyproduct,contractingpartiesshallaimatadistributionoftradeinsuchproductapproachingascloselyaspossibletheshareswhichthevariouscontractingpartiesmightbeexpectedtoobtainintheabsenceofsuchrestrictionsandtothisendshallobservethefollowingprovisions:

  (d)Incasesinwhichaquotaisallocatedamongsupplyingcountriesthecontractingpartyapplyingtherestrictionsmayseekagreementwithrespecttotheallocationofsharesinthequotawithallothercontractingpartieshavingasubstantialinterestinsupplyingtheproductconcerned.Incasesinwhichthismethodisnotreasonablypracticable,thecontractingpartyconcernedshallallottocontractingpartieshavingasubstantialinterestinsupplyingtheproductsharesbasedupontheproportions,suppliedbysuchcontractingpartiesduringapreviousrepresentativeperiod,ofthetotalquantityorvalueofimportsoftheproduct,dueaccountbeingtakenofanyspecialfactorswhichmayhaveaffectedormaybeaffectingthetradeintheproduct.Noconditionsorformalitiesshallbeimposedwhichwouldpreventanycontractingpartyfromutilizingfullytheshareofanysuchtotalquantityorvaluewhichhasbeenallottedtoit,subjecttoimportationbeingmadewithinanyprescribedperiodtowhichthequotamayrelate.

  (c)(i)If,inthecourseofconsultationswithacontractingpartyundersubparagraph(a)or(b)above,theCONTRACTINGPARTIESfindthattherestrictionsarenotconsistentwithprovisionsofthisArticleorwiththoseofArticleXIII(subjecttotheprovisionsofArticleXIV),theyshallindicatethenatureoftheinconsistencyandmayadvisethattherestrictionsbesuitablymodified.

  (ii)If,however,asaresultoftheconsultations,theCONTRACTINGPARTIESdeterminethattherestrictionsarebeingappliedinamannerinvolvinganinconsistencyofaseriousnaturewiththeprovisionsofthisArticleorwiththoseofArticleXIII(subjecttotheprovisionsofArticleXIV)andthatdamagetothetradeofanycontractingpartyiscausedorthreatenedthereby,theyshallsoinformthecontractingpartyapplyingtherestrictionsandshallmakeappropriaterecommendationsforsecuringconformitywithsuchprovisionswithinthespecifiedperiodoftime.Ifsuchcontractingpartydoesnotcomplywiththeserecommendationswithinthespecifiedperiod,theCONTRACTINGPARTIESmayreleaseanycontractingpartythetradeofwhichisadverselyaffectedbytherestrictionsfromsuchobligationsunderthisAgreementtowardsthecontractingpartyapplyingtherestrictionsastheydeterminetobeappropriateinthecircumstances.

  (b)Ifagreementisnotreachedwithinsixtydaysafterthenotificationprovidedforinsubparagraph(a)above,thecontractingpartywhichproposestomodifyorwithdrawtheconcessionmayreferthemattertotheCONTRACTINGPARTIESwhichshallpromptlyexamineit.Iftheyfindthatthecontractingpartywhichproposestomodifyorwithdrawtheconcessionhasmadeeveryefforttoreachanagreementandthatthecompensatoryadjustmentofferedbyitisadequate,thatcontractingpartyshallbefreetomodifyorwithdrawtheconcessionif,atthesametime,itgiveseffecttothecompensatoryadjustment.IftheCONTRACTINGPARTIESdonotfindthatthecompensationofferedbyacontractingpartyproposingtomodifyorwithdrawtheconcessionisadequate,butfindthatithasmadeeveryreasonableefforttoofferadequatecompensation,thatcontractingpartyshallbefreetoproceedwithsuchmodificationorwithdrawal.Ifsuchactionistaken,anyothercontractingpartyreferredtoinsubparagraph(a)aboveshallbefreetomodifyorwithdrawsubstantiallyequivalentconcessionsinitiallynegotiatedwiththecontractingpartywhichhastakentheaction.

  1.Ifanycontractingpartygrantsormaintainsanysubsidy,includinganyformofincomeorpricesupport,whichoperatesdirectlyorindirectlytoincreaseexportsofanyproductfrom,ortoreduceimportsofanyproductinto,itsterritory,itshallnotifytheCONTRACTINGPARTIESinwritingoftheextentandnatureofthesubsidization,oftheestimatedeffectofthesubsidizationonthequantityoftheaffectedproductorproductsimportedintoorexportedfromitsterritoryandofthecircumstancesmakingthesubsidizationnecessary.Inanycaseinwhichitisdeterminedthatseriousprejudicetotheinterestsofanyothercontractingpartyiscausedorthreatenedbyanysuchsubsidization,thecontractingpartygrantingthesubsidyshall,uponrequest,discusswiththeothercontractingpartyorpartiesconcerned,orwiththeCONTRACTINGPARTIES,thepossibilityoflimitingthesubsidization.

  3.Accordingly,contractingpartiesshouldseektoavoidtheuseofsubsidiesontheexportofprimaryproducts.If,however,acontractingpartygrantsdirectlyorindirectlyanyformofsubsidywhichoperatestoincreasetheexportofanyprimaryproductfromitsterritory,suchsubsidyshallnotbeappliedinamannerwhichresultsinthatcontractingpartyhavingmorethananequitableshareofworldexporttradeinthatproduct,accountbeingtakenofthesharesofthecontractingpartiesinsuchtradeintheproductduringapreviousrepresentativeperiod,andanyspecialfactorswhichmayhaveaffectedormaybeaffectingsuchtradeintheproduct.

  (ii)toremoveatemporarysurplusofthelikedomesticproduct,or,ifthereisnosubstantialdomesticproductionofthelikeproduct,ofadomesticproductforwhichtheimportedproductcanbedirectlysubstituted,bymakingthesurplusavailabletocertaingroupsofdomesticconsumersfreeofchargeoratpricesbelowthecurrentmarketlevel;or

  3.(a)Contractingpartiesundertake,incarryingouttheirdomesticpolicies,topaydueregardtotheneedformaintainingorrestoringequilibriumintheirbalanceofpaymentsonasoundandlastingbasisandtothedesirabilityofavoidinganuneconomicemploymentofproductiveresources.Theyrecognizethat,inordertoachievetheseends,itisdesirablesofaraspossibletoadoptmeasureswhichexpandratherthancontractinternationaltrade.

  15.If,withinthirtydaysofthenotificationofthemeasure,theCONTRACTINGPARTIESdonotrequestthecontractingpartyconcernedtoconsultwiththem,thatcontractingpartyshallbefreetodeviatefromtherelevantprovisionsoftheotherArticlesofthisAgreementtotheextentnecessarytoapplytheproposedmeasure.

  1.Notwithstandingtheprovisionsofparagraph1ofArticleXI,anycontractingparty,inordertosafeguarditsexternalfinancialpositionanditsbalanceofpayments,mayrestrictthequantityorvalueofmerchandisepermittedtobeimported,subjecttotheprovisionsofthefollowingparagraphsofthisArticle.

  (c)Importrestrictionsonanyagriculturalorfisheriesproduct,importedinanyform,necessarytotheenforcementofgovernmentalmeasureswhichoperate:

  ArticleXIX:EmergencyActiononImportsofParticularProducts
